Sandy Hook Shooting Lawsuit: Town Asks Judge To Toss Case

Lawyers for the town and Board of Education are asking a judge to toss a wrongful death lawsuit filed on behalf of two shooting victims.

NEWTOWN, CT — The Town of Newtown is asking a judge to toss a case filed by parents of two children killed in the Sandy Hook Elementary School shooting in 2012.

The town argues that “there is no genuine issue of fact regarding the defendants’’ alleged negligence,” and that the town and Board of Education are entitled to governmental immunity, according to a motion for summary judgement filing.

The lawsuit alleged that there were security lapses as the school at the time of the shooting. It alleges that teachers couldn’t lock some doors from the inside among other claims in a 64-page complaint. It was filed on behalf of the estates of Jesse Lewis and Noah Pozner, two of the children killed in the attack.

The shooter killed 20 children and six educators on Dec. 14, 2012. Last year the parents offered the town an $11 million settlement.

A Superior Court judge dismissed an unrelated lawsuit filed against the manufacturer, distributor and seller of the AR-15 rifle used in the attack.
