Real Estate Holdings, LLC 140 Nod Road and Flamig Farm Earth Products have not paid taxes to the Town.

Real Estate Holdings, LLC has an application before the Zoning Commission for a Zone Change, Application ZC #25-07, of Simsbury Real Estate Holdings, LLC, Applicant, for a text amendment to the Simsbury Zoning Regulations Section 3 (Residential Districts) and Section 17 (Definitions) to allow an additional use--Special Recreation Area—in the R-40, R-80, and R-160 Zones.
Flamig Farm Earth Products has a lawsuit against the Town on a tax appeal.

Both these businesses and others that are in arrears in their taxes are allowed to ask for special exceptions or expansions.
A person cannot register their motor vehicles if they have not paid their taxes.
The Town should follow the DMV and develop a policy restricting anyone from applying to the Town for approval of applications or other related activities until they comply with the Town regulations.
I assume, my comments triggered the document the Board of Selectmen and Town Staff provided for comment on receiving permits, Public Hearing Notice - Withholding Building Permits on Delinquent Tax Property.
The document provides an escape clause for delinquencies on a case-by-case provision.
This should be eliminated.
The Board of Selectmen passed an Ordinance forcing people to take personal responsibility for their dog’s poop, without an escape clause.
People should take personal responsibility for their finances and pay taxes when due before adding additional projects.
Otherwise, you are condoning “Ponzi Schemes” that can lead to more defaults.
Town staff should not be placed in a precarious situation of interpretation of the escape clause.
This could lead to lawsuits on interpretation of the document at great cost to the Town for being arbitrary and capricious.
The document should state simply, that delinquent taxes and other land use violations are cause for rejecting additional permits.
Delinquent taxes from the Tax Department list, should be forwarded to the Building Department.
All applicants applying for permits must show that they have no tax delinquencies to staff.
This proposal should be withdrawn until a proposal is written with a clear and concise document.
