Drunk Man Who Broke His Leg While Wearing Flip-Flops Loses $1.5M Suit Against Redding
A man who sued the Town of Redding after sustaining injuries jumping from a 6-foot high wall while wearing flip-flops has lost the lawsuit.
REDDING, CT — The Town of Redding won a $1.5 million lawsuit against a man who sued when he was intoxicated and broke his leg after jumping off of a 6-foot high retaining wall wearing flip-flops in 2011, the Connecticut Law Tribune reports.
According to court documents, the plaintiff alleged that he was injured when he fell off a wall that was constructed with no protective fencing by M. Rondano, Inc., contractor for the Town of Redding. The complaint alleged that the wall was built on public land and constituted a public nuisance, the suit states.
The plaintiff claimed that the court improperly concluded that "the defendant did not design the wall, had no control over the wall, and no longer controlled the wall when the fall occurred." The plaintiff also argued that "the defendant had control of the property because it had significant input into the design and construction of the project, and failed to include a fence in its design."

In another case, Brandon Smith brought a similar action against the Town of Redding and lost. Court records show that the trial court granted judgment to the defendant, B.L. Companies, Inc. Smith withdrew his appeal.
