Report: Conviction Overturned in Bethel Sexual Assault Case

Connecticut Supreme Court threw out a 2010 conviction for sexual assault of a minor due to problems with the prosecution.

The state Supreme Court has thrown out the sexual assault conviction against a Bethel man due to prosecutorial misconduct, the News-Times reported Wednesday.

Bethel resident Michael Maguire was convicted in 2010 of sexually assaulting an 8-year-old Ridgefield girl in 2008.

He was sentenced to 54 months imprisonment for sexual assault in the fourth degree and 12 years, suspended after 78 months, for illegal sexual contact, however a higher court determined that the prosecutor misled the jury during closing arguments.

Maguire pled ‘not guilty’ to both charges.

According to News-Times reporter John Pirro, the State’s Attorney “hasn’t yet decided whether to retry Maguire.”
