90-Year-Old Disabled Woman In FL Sexually Assaulted By Caretaker: Cops

Police in Florida said a nursing assistant was caught committing a sex act on an elderly patient who has dementia and is bedridden.

NEW SMYRNA BEACH, FL — Police in Florida said a nursing assistant was recently caught committing a sex act on a 90-year-old patient who has dementia and is bedridden.

Billy Bunn, 51, of Daytona Beach has been charged with battery on a person 65 years of age or older and lewd or lascivious battery in the presence of an elderly/disabled person.

According to the New Smyrna Beach Police Department, Bunn, who worked at Vitas Healthcare, exposed himself and forced the victim, who is under 24-hour care, to touch him in an inappropriate manner.

"The defendant should have known the victim lacked the capacity to give consent," a portion of the incident report reads.

Police said another caretaker at the facility actually witnessed the incident and notified the authorities.

While doing her rounds to check on everyone, police said the caretaker walked into the elderly victim's room around 4:25 p.m. and caught Bunn with the victim in a compromising position.

The witness said she then exited the room and contacted the owner of the hospice house.

Police said the owner notified Vitas to tell them what occurred and informed Bunn that he needed to leave his badge and cellphone at the house.

A general manager with Vitas contacted the Department of Children and Families and also informed the hospice house owner that an internal investigation is underway. The New Smyrna Beach Police was also notified.

By then, Bunn had left the facility.

When police arrived, officers said the victim appeared safe and uninjured.

The victim's daughter, who has power of attorney for her mother, told officers she wanted to press charges.

Officers ultimately arrested Bunn at his home in Daytona Beach.

After reading him his Miranda Rights, officers said Bunn agreed to speak to them.

Police said he confirmed that he worked for Vitas and was in the patient's room; however, he denied doing anything sexually inappropriate with the patient.

"Billy could not explain to me why the other caretaker would say that or what she saw," a portion of the police report states.

Bunn was transported to the Volusia County Branch Jail. He was released Thursday on a $5,000 surety bond.

It wasn't immediately clear if Bunn is still employed with Vitas; however, the company told WESH-TV that it takes the allegations against Bunn seriously and that patients' health and well-being are at the heart of everything they do.
