Shootout At Haines City Bar Kills 1, Injures 1, Suspect In Jail: Cops
A Polk County man faces a first-degree murder charge after deputies accused him of shooting two people in a gunfight Sunday at a bar.

POLK COUNTY, FL - A 31-year-old Haines City man is accused of instigating a shootout in a bar parking lot that killed one man and injured another one Sunday evening, Sheriff Grady Judd said Monday at a news conference.
Joshua Badillo faces charges of attempted first-degree murder and felony first-degree murder. There could be additional charges, Judd said.
At about 5:12 p.m, Badillo walked into Shady Cove Bar & Grill, 7140 State Road-544, Haines City. A motorcycle group who had ridden in a charity event earlier in the day were already inside sitting down. Badillo, who is accused of being under the influence, began talking to the group, according to Judd.

An argument ensues and then Badillo calms the group down by offering to buy them a round of drinks. The group then goes outside and sits in the Tiki Bar area without Badillo.
"So they're sitting around at a table," Judd said. "Josh Badillo comes back. Comes up in the middle of the group, sits down in a chair, starts to talk, reaches out across the table-and we can see in the video where he grabs a guy's hand and shakes his hand. And he holds his hand for an extended period of time...he turns him loose and he's just kind of all up in their business."

One of the men from the motorcycle group then asks bar security if they could remove Badillo. The security guard then walks him out to the parking lot with assistance from a larger male in the motorcycle group, according to Judd.
"The particular big guy, which turns out to be victim no. 1, is kind of in his face telling him he needs to leave," Judd said. "He goes back toward his truck slowly and begrudgingly with some people he knows from the bar encouraging him to leave. To get in his truck. So they're kind of pushing him and encouraging him to go across the parking lot. When all of a sudden he turns and runs past two people trying to get him in his truck."
Badillo ran up to victim no. 1 and is accused of shooting him through the hand and through the groin with one shot from a .40 caliber pistol, Judd said.
Then a man ran out of the bar with a .38 caliber gun and is accused of shooting at Badillo. A gunfight ensued between victim no. 2 and Badillo in the parking lot, Judd said.
"Victim 2 is shot in the chest," Judd said. "He falls down. He gets back up and staggers back toward the bar where he once again falls."
Badillo is accused of driving away and getting into a crash that he drove away from. Badillo went back to his house. The suspect was inside his home when deputies arrived, according to Judd.
"We walk around his truck, and we see blood," Judd said. "Turns out Joshua Badillo is shot as well."
Forty-five minutes later, Badillo surrendered to deputies and they took him to the hospital.
Medical staff told deputies Badillo had been shot in his upper armpit and the bullet exited his back.
Victim 2, a 52-year-old man of Plant City, died of a gunshot wound to his chest on Sunday at a local hospital, Judd said.
Victim 1, a 32-year-old Lakeland man, was last listed in stable condition at a local hospital, deputies said.
Badillo was treated at the hospital and released to the Polk County Jail, Judd said.
Judd said he knows some of the witnesses left because there were stilettos and knives left on the concrete outside the bar.
