6-1D: .04(6)(i)According to management, the time temperature controlled foods in the open top coolers and the dressings for self-service were on time as a control for food safety. Product was placed in the coolers and at self-service area at 11AM and were going to be discarded at 3PM. The managers stated that they were using time as a control for food safety for the items in the prep coolers because both coolers were found to be malfunctioning that morning. Written procedures for using time as control for food safety were not prepared in advance. Product was not labeled with the time when removed from temperature control and/or the discard time.(Foods on time control included cheeses, cut tomatoes, cut lettuce, slaw, guacamole with cut tomatoes, raw meats/fish, dressings made on-site). // "When using Time Control (TPHC) for a maximum of 4 hours: 1) hot foods shall start at 135°F (57°C) or above and cold foods shall start at 41°F (5°C) or below; 2) the food items shall be labeled with a start and discard time, not to exceed 4 hours; 3) foods not consumed before the discard time shall be discarded; 4) when combining ingredients, the start/discard time for the foods shall reflect the start/discard time of the earliest ingredient placed on time control; 5) written procedures TPHC shall be created in advance and made available upon the Health Authorities request."
Corrective Actions: Written procedures to use time as a control for food safety were prepared. Each container with a TCS food was labeled with 11-3. Product was then discarded at 3PM.
10D: .04(4)(d)Multiple items removed from containers not relabeled with the common name (e.g., breading, panko, sugar, grill min). // Except for containers holding food that can be readily and unmistakably recognized, such as dry pasta, working containers holding food or food ingredients that are removed from their original packages for use in the food establishment, such as cooking oils, flour, herbs, potato flakes, salt, spices, and sugar shall be clearly and legibly identified, in English, with the common name of the food.
Corrective Actions: Each container labeled with the common name of the food. //
14B: .05(10)(e) 1,2,4Multiple pans wet-stacked. // "After cleaning and sanitizing, equipment and utensils: 1. Shall be air-dried or used after adequate draining before contact with food; and 2. May not be cloth dried except that utensils that have been air-dried may be polished with cloths that are maintained clean and dry." [If this item is marked out of compliance on the next routine inspection, then the food permit may be supended.]
Corrective Actions: Pans relocated to the warewashing area to be rewashed. //
15B: .05(6)(d),(e)Interior of dishwasher with lime build up. // A warewashing machine and its auxiliary components shall be operated in accordance with the machine's data plate and other manufacturer's instructions.
15C: .05(7)(a)2,3Build up on sides of cooking equipment and the casters to equipment. Glue and label residue still present on sides of food containers stored as clean. // Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris. [If this item is marked out of compliance on the next routine inspection, then the food permit may be supended.]
17A: .06(5)(h)Trashcan with a lid not provided in the designated employee restroom. // (h) Toilet Room Receptacle, Covered. A toilet room used by females shall be provided with a covered receptacle for sanitary napkins.
17C: .07(5)(a),(b)Floor under the cooking equipment with trash and other heavy build up (e.g., grease). // All physical facilities shall be maintained in good repair and shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. Employees shall consume food and drink only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas (unless drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee's hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles).
Corrective Actions: Employee drinks discarded.
2-2D: .06(2)(g)The two handwashing sinks in the kitchen do not have hot water. The two handwashing sinks in the kitchen must have hot water by 3/6/2020. A handwashing sink shall be equipped to provide tempered water at a temperature of at least 100ºF (38ºC) through a mixing valve or combination faucet.
4-1A: .04(4)(c)Observed raw shelled eggs stored over ready to eat foods in the walk in cooler and in the prep line cooler. Observed raw hamburger meat stored over raw pork and raw fish in the drawer prep line cooler. Observed raw chicken stored over raw beef in the drawer prep line cooler. Must display, store, prepare, and hold foods so they are protected from cross contamination.
Corrective Actions: Foods were properly stored and separated.
6-1A: .04(6)(f)Multiple time/temperature control for safety (TCS) foods cold holding improperly for more than 4 hours (3 bags of spinach, cut green tomatoes, 1 container of cut lettuce, 1 container of cooked grape leaves and rice). Per CFSM, the bags of spinach were delivered earlier today. Per CFSM, he did not check the the temperature of the spinach when it was delivered. Per CFSM, he only checked the temperatures of the delivered meats. Time/temperature control for safety food shall be maintained at 41°F (5°C) or below. **2nd CONSECUTIVE REPEAT VIOLATION ON A ROUTINE INSPECTION**
Corrective Actions: Foods discarded. Discussed with CFSM and employees that facility should also check the delivered temperatures of dairy food items and cut leafy greens.
6-1C: .04(6)(d)Multiple TCS foods did not cool properly or not cooling at a rate fast enough to cool properly (3 containers of cooked rice, 2 pans of cooked potatoes, 1 container of cut lettuce, 2 containers of cut tomatoes). Cooked time/temperature control for safety food shall be cooled: 1) from 135°F (57°C) to 70°F (21°C) within 2 hours; and 2) from 70°F (21°C) to 41°F (5°C) or below within 4 hours (provided the food met the first limit). Time/temperature control for safety foods prepared from room temperatures or refrigeration temperatures shall be cooled from 70°F to 41°F (5°C) or below within 4 hours.
Corrective Actions: Foods that did not cool properly were discarded. Instructed CFSM to move foods that were still in the cooling process to the walk in freezer.
6-1D: .04(6)(i)Observed 2 containers of garlic butter and 1 container of aoli sauce stored on time control without a start or discard time. Per cook, foods had just been placed on time control. Foods did not have an initial start temperature of 41 degrees Fahrenheit ore less or 135 degrees Fahrenheit or greater. Per employee, the 2 containers of garlic butter were prepared 2 hours ago. Facility did not have time control procedures. "When using Time Control (TPHC) for a maximum of 4 hours: 1) hot foods shall start at 135°F (57°C) or above and cold foods shall start at 41°F (5°C) or below; 2) the food items shall be labeled with a start and discard time, not to exceed 4 hours; 3) foods not consumed before the discard time shall be discarded; 4) when combining ingredients, the start/discard time for the foods shall reflect the start/discard time of the earliest ingredient placed on time control; 5) written procedures TPHC shall be created in advance and made available upon the Health Authorities request." **2nd CONSECUTIVE REPEAT VIOLATION ON A ROUTINE INSPECTION**
Corrective Actions: 2 containers of garlic butter were placed in the walk in freezer to ensure proper cooling. Aoli sauce was discarded. Time control procedures were emailed to CFSM during inspection.
11A: .04(6)(e)Facility using improper methods for cooling TCS foods. Foods cooling in the walk in cooler (pans of cooked potatoes, lettuce, and one container of cooked rice) were farthest away from the fans (large boxes of produce blocking the air flow in the walk in cooler to properly cool foods). 2 containers of cooked rice and 2 containers of cut tomatoes cooling in the prep line coolers where high levels of worker activity are occurring. Foods shall be cooled using one or more methods approved by the health authority (i.e., small batches, thinner portions, ice wands, blast chillers, ice as an ingredient, placing in the walk-in cooler or walk-in freezer uncovered (or partially uncovered) as long as the food is protected from overhead contamination).
Corrective Actions: Discussed with CFSM about reorganizing the walk in cooler so that the foods that are cooling are on the top shelf of the walk inc cooler directly under the fan and moving produce boxes to the other side of the cooler. Foods that did not cool properly were discarded. Instructed CFSM to move foods that were still in the cooling process to the walk in freezer to rapidly cool.
11C: .04(6)(c)At time of inspection, observed raw beef storing at room temperature in the 3 compartment sink (1 package of raw beef thawing in a container of still water). Observed 2 containers of pesto sauce cooling at room temperature. Time/temperature control for safety shall be thawed: 1) under refrigeration that keeps the food at 41°F or below; 2) completely submerged in running water with the temperature of the water at 70°F or below, and the no part of the food exceeding 41°F; 3) as a part of the cooking process.
Corrective Actions: Raw beef was moved to the walk in cooler to continue thawing. Pesto sauce was moved to the prep line cooler to continue thawing.
12B: .03(5)(g)Observed 2 employees handling food while wearing a watch and a bracelet. Food employees may not wear jewelry including medical information jewelry on their arms and hands while preparing food (except for a plain ring such as a wedding band).
Corrective Actions: Employees removed jewelry.

Employees must wash hands and exposed portions of arms immediately before engaging in food preparation including working with exposed food, clean equipment and utensils, and unwrapped single-service articles, and: 1) after touching exposed body parts; 2) after using the restroom; 3) after coughing, sneezing, using tobacco, eating, or drinking; 4) after handling soiled equipment or utensils; 5) during food preparation, as often as needed to remove soil and contamination and to prevent cross contamination when changing tasks; 6) before putting on gloves; 7) after engaging in other activities that contaminate hands; 8) a second time when entering the kitchen from using the restroom.
Corrective Actions: Employee was educated on when to wash hands. Onion was discarded.
2-2A: .03(4)(a)(b)(c)(e)(f)PIC could not provide employee health forms for employees on staff. Food employees and conditional employees shall be informed in a verifiable manner of their responsibility to report to the person in charge information about their health and activities as they relate to diseases that are transmissible through food.
Corrective Actions: The PIC as well as all staff present were educated on proper protocol of the health policy, and knowing when to report any signs as well as symptoms. Also Employee Health Policy Requirements handout was provided to the PIC.
2-2D: .06(2)(o)Observed a food container in the hand washing sink. A handwashing facility may not be used for purposes other than handwashing.
Corrective Actions: PIC removed the food container.
6-1D: .04(6)(i)Facility could not provide procedures for items that were on time control. Did not have start and discard time on items. Corrective Actions: Facility was given a blank TPHC form today and filled the form out with all items that will be on time control.
12A: .04(4)(q)Observed food items stored on the floor in the WIF. "Food shall be protected from contamination by storing the food: 1) in a clean dry location; 2) where it is not exposed to splash, dust, or other contamination; and 3) at least 6 inches (15 cm) above the floor." **2ND REPEAT
Corrective Actions: PIC picked all food items up off of the floor.
13A: .02(1)(d)Facility did not have the most recent inspection report on display. Facility had Inspection Report dated from 06/12/2019 on display. The most current inspection report shall be prominently displayed in public view at all times, within fifteen feet of the front or primary public door and between five feet and seven feet from the floor and in an area where it can be read at a distance of one foot away.
Corrective Actions: PIC will replace the score with the one from today.
15C: .05(7)(a)2,3Observed several shelving with accumulation of food and debris. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
Corrective Actions: Have violation corrected by 02/28/2020
17D: .07(4)(b)Observed several jackets stored with clean utensils. Employee personal items (keys phones, jackets, etc) shall be stored away from food prep surfaces, equipment, utensils, and single service items.
Corrective Actions: PIC moved all jackets to a designated area.

16B: .06(2)(j)Backflow devices not installed on the water hoses used at the utensil sink and fryer. If not provided with an air gap as specified under subsection (2)(d) of this Rule a double check valve with an intermediate vent preceded by a screen of not less than 100 mesh to 1 inch (100 mesh to 25.4 mm) shall be installed upstream from a carbonating device and downstream from any copper in the water supply line.
