Grandmother Charged with Vehicular Homicide, DUI in Death of Monroe 4-Year-Old

Second passenger remains in critical condition at Atlanta Medical Center.

Cynthia Lynn Miller, 50, of Monroe, has been charged with first degree vehicular homicide, driving under the influence (drugs), serious injury by vehicle and failing to maintain lane after an accident in Morgan County Monday resulted in the death of her grandson and the critical injury of another family member.

According to a spokesman from the Georgia State Patrol, the charges were filed after Joshua Allen Cole, 4, from Monroe, was killed in the single vehicle accident in Morgan County on Monday afternoon. Brandy Malcom, 32, also of Monroe was critically injured in the same wreck. Malcom is the half-sister of Miller and remains in a critical condition at Atlanta Medical center, according to GSP.

Miller was driving on Georgia 83 and was four miles north of Madison at about 4:55 p.m. Monday when the car left the roadway while negotiating a curve, police said. She over-corrected, causing the vehicle to rotate across both lanes and leave the road before hitting a tree.
