Roswell Approves Old Alabama Road Retail, Multi-Family Project

The project would contain about 100 residential units and 8,000 square feet of retail space.

ROSWELL, GA — The Roswell City Council at its Monday meeting voted to approve a rezoning petition that would accommodate a mixed-use project featuring nearly 100 residential units and thousands of square feet of retail space.

The Council voted 4-2, with Marcelo Zapata and Michael Palermo opposing, to grant the request from Eyal Livent of Duke Land Group to rezone 21.2 acres on Old Alabama Road north of Riverside Road from OP-Office Park to Commercial Mixed Use (CX). An initial motion to deny the project came up for a vote, but failed to garner enough support to pass the Council.

The project would contain a town home and multi-family development with 99 residential units and 8,000 square feet of space. Council members approved the project with a slew of conditions, which consisted of a mix of recommendations from city staff and members of the Martins Landing Foundation neighborhood.   • The owner/developer shall provide appropriate sidewalk crossing at the roundabout which is similar to the opposite side of the roundabout.
  • The owner/developer shall accommodate potential inter-parcel connectivity.
  • The applicant shall provide 8,000 square feet for commercial. Roswell will not issue permits for more than 50 of the residential units before the commercial is complete.
  • The stacked flat condominium units shall be for sale housing and shall not be offered for rent by the developer. Once turned over to the HOA, by covenant restriction, no more than 10 percent of the units may be rented by the owners.
  • All lighting from property and improvements controlled so they do not negatively affect homes in the Martins Landing neighborhood.

According to city documents, Duke Land Group disclosed that a member of Roswell Land Group, LLC — an affiliate of Duke — made campaign contributions in November 2017 in the amount of $750 each to Council members Marie Willsey of Post 4, Matt Tyser of Post 5 and Matt Judy of Post 6. Those three Council members, who were candidates seeking elected office at the time of the donations, voted in favor of the project, along with fellow Councilman Sean Groer.
