NYE DUI Initiative Nets 6 Arrests: Kane County State's Attorney
Six drivers, including one from Aurora and one from St. Charles, were charged with driving under the influence on New Year's Eve.
KANE COUNTY, IL — Police officers and deputies participating in the Kane County State's Attorney's Office's anti-DUI operation for New Year's Eve arrested six intoxicated drivers, officials said.
A collaborative effort between 13 law enforcement agencies in Kane County, the "No-Refusal operation" took place from 11 p.m. Dec. 31 to 3 a.m. Jan. 1. The initiative was designed to assist police in obtaining search warrants for people who refuse to submit to chemical testing after a DUI arrest. The Aurora, Batavia, Geneva and St. Charles police departments and Kane County Sheriff's Office were among the participating agencies.
After suspected intoxicated drivers were arrested, they were taken to their local police station and asked to submit to a breathalyzer or other chemical testing. If the person refused, they were informed by an assistant state's attorney that a court order would be sought to order them to comply. The suspect would then face additional charges if they continued refusing.

Illinois courts have previously held that a person has no right to refuse chemical testing when probable cause exists, the Kane County State's Attorney's Office said in a news release.
The Kane County State's Attorney's Office obtained three search warrants for drivers who refused to submit to testing on New Year's Eve.

"I am deeply grateful to the dedicated law enforcement officers who work tirelessly to keep our streets safe," Kane County State's Attorney Jamie Mosser said in a statement. "It is unfortunate that these individuals chose to drive under the influence, endangering themselves and others. The safety of our community must always come first, and initiatives like these send a clear message—we will not tolerate reckless and dangerous behavior on our roads."
The following people were arrested and charged during the operation:
Aurora Police Department
- Stanislav L. Yosifovski, 47, of the 00 block of S. Stolp Ave. in Aurora. He was arrested at 11:17 p.m. Dec. 31 and charged with obstructing justice, driving under the influence of alcohol and a traffic offense.
Elburn Police Department
- Noah F. Alvarez, 24, of the 400 block of Normal Road in DeKalb. He was arrested at 1:30 a.m. Jan. 1 and charged with two counts of driving under the influence of alcohol as well as traffic offenses.
Elgin Police Department
- Raul Torres-Chavez, 36, of the 1800 block of Walnut St. in St. Charles. He was arrested at 1:01 a.m. Jan. 1 and charged with two counts of aggravated driving under the influence, driving under the influence of alcohol and traffic offenses. Blood results are pending under a search warrant that was obtained.
Kane County Sheriff's Office
- Christopher J. Landeros, 27, of the 300 block of Sonoma Road in Jacksonville, North Carolina. He was arrested at 11:50 p.m. Dec. 31 and charged with driving under the influence of alcohol. Blood results are pending under a search warrant that was obtained.
- Austin S. Andres, 26, of the 200 block of Quarry St. in South Elgin. He was arrested at 12:18 a.m. Jan. 1 and charged with driving under the influence of drugs.
- Ian Scott, 87, of the 00 block of Tyler Court in Streamwood. He was arrested at 12:59 a.m. on Jan. 1 and charged with driving under the influence of alcohol and a traffic offense.
