State's Attorney's Office, Police Team Up For New Year's DUI Operation
Assistant state's attorneys will help police obtain search warrants on New Year's Eve for suspect DUI drivers refusing to submit to testing.
KANE COUNTY, IL — The Kane County State's Attorney's Office will implement an anti-DUI initiative on New Year's Eve in hopes of keeping local roads safe from impaired drivers.
Called a "No-Refusal operation," the initiative will start at 11 p.m. Dec. 31 and end at 3 a.m. Jan. 1.
During the four-hour time frame, the state's attorney's office will work with local police agencies by helping officers obtain search warrants for people who refuse to submit to chemical testing after a DUI arrest. Assistant state's attorneys will be on hand to assist police through the process to compel a DUI suspect to submit to a lawfully requested blood, breath or urine test, according to a news release.

Illinois courts have previously held that a person has "no right to refuse chemical testing when probable cause exists," officials said. Someone who declines to submit to testing after being presented with a search warrant could face additional charges.
In the office's previous No-Refusal operation, on the day before Thanksgiving, often referred to as "Blackout Wednesday," four drivers were arrested and charged with driving under the influence, Patch reported.

The upcoming New Year's Eve operation will be the office's 38th since the program's inception in 2008.
"The night of New Year’s Eve is a time for getting together to celebrate and ring in the new year," State's Attorney Jamie Mosser said in a statement. "While we don’t wish to discourage counting down to midnight and singing Auld Lang Syne, choosing to drink excessively and then getting behind the wheel is the absolute wrong way to start 2025. We want to remind individuals that designated drivers, taxis, Uber, and Lyft are all excellent options for getting home responsibly. Our goal with 'No-Refusal' operations is to ensure Kane County’s roads remain safe for everyone.
