Man Drinking Liquor Near Railway Tracks Kicks Cop: Des Plaines PD

The Des Plaines man was charged with a felony for the incident that occurred Thursday night.

DES PLAINES, IL — A 51-year-old Des Plaines man has been charged with a felony after kicking a police officer in the shin Thursday night after being arrested. John Bartosiak, of the 1200 block of E. Golf Road, is accused of felony aggravated battery to a peace officer, as well as resisting a peace officer, improper walking on highways, pedestrian under the influence of alcohol, drinking in a public place.

The Cook County Sheriff's Office approved the felony charge.

Des Plaines police responded to the 100 block of S. Des Plaines River Road at 7:31 pm. Thursday, to check on the well-being of a man seen walking in traffic. He was described as wearing a khaki colored top and walking close to the railway tracks in that area.

Responding officers stopped on the north side of the crossing in that area and saw Bartosiak crossing the street westbound and then lay on the ground in an attempt to hide. After being stopped by police, Bartoskiak said he was traveling to an address nearby. Police said they noticed a bottle of liquor inside his jacket pocket. The officer removed the alcohol and noted that the bottle had been opened, which is a city violation.

Bartosiak reportedly attempted to walk away from the officers, was advised to stop, to which he disobeyed and continued walking away even after being told he would be placed under arrest if he continued to do so. Bartosiak was stopped by the officer and, throughout the remainder of the interaction, kept attempting to walk away from police.

Bartosiak was told he was under arrest and while taking him into custody, he repeatedly tensed his arms to prevent the officers from being able to do so. Police said Bartosiak then used his leg to kick one of the officers in the shin. Eventually, Bartosiak was taken into custody and moved to the Des Plaines Police station.
