Elgin Man Guilty Of Sexually Assaulted Child Younger Than 13: Mosser

Kane County prosecutors requested a term totaling 65 years for the six counts related to sexual abuse of a child, officials said.

ELGIN, IL — An Elgin man was sentenced to 27 years in prison for sexually assaulting a child under the age of 13, according to the Kane County State's Attorney's Office.

Jacob Gutierrez, 35, was found guilty of four counts of predatory criminal sexual assault and two counts of aggravated criminal sexual abuse.

Officials said the child told a trusted adult that she was sexually penetrated and abused by the man. The adult then made a report to the Department of Children and Family Services.

Gutierrez, of the 200 block of Douglas Avenue, faces between 6 to 60 years on each count of predatory criminal sexual assault and a possible term between 3 to 14 years for the aggravated criminal sexual abuse charge. He'd be required to serve 85 percent of the former sentence and 50 percent of the latter, according to a news release.

At a sentencing hearing, prosecutors requested a term totaling 65 years.

Gutierrez is credited for the 722 days spent in the Kane County jail. He will also be required to register for life as a sexual offender.

"No sentence will ever be enough for the abuse this child suffered over many years, but thanks to this child bravely coming forward and testifying in court against her abuser, this defendant is now being held accountable for his actions," Wittman said in a statement.
