EVANSTON, IL — Prosecutors charged one of the two men shot Monday evening on Dempster Street with illegally having a gun and petitioned for him to be jailed while awaiting trial.

Sean Gayle, 41, exchanged gunfire with a 50-year-old Evanston man outside his home in the 1700 block of Dempster Street around 8:30 p.m., authorities said.

Officers arrived to find Gayle suffering from multiple gunshot wounds, lying on the ground beside a black Ruger LCP 380, according to the Cook County State's Attorney's Office, who approved one count of aggravated unlawful use of a weapon by a felony.

Police said the investigation revealed that Gayle and the other man shot each other as part of an ongoing dispute.

Assistant State's Attorney Nick Campbell filed a petition to deny Gayle's pretrial release at a hearing Friday in Skokie, noting the charge was non-probationable. He said Gayle identified the man who shot him, and that man remains under investigation.

Gayle remains at Evanston Hospital, so a hearing on the petition was postponed until Wednesday morning.
