Frankfort Man Convicted of 2009 Murder Tries For New Trial

The Frankfort man's attorneys tried to convince a judge to give him another shot in court.

The attorneys for a Frankfort man convicted of gunning down a female friend in 2009 tried to convince the judge who found him guilty to give him another trial.

The lawyers for Brian Trainauskas, 40, argued the merits of evidence introduced at trial — and whether some of it should have been allowed in at all.

Will County Judge Dave Carlson found Trainauskas guilty in June. During Wednesday’s hearing for a new trial, Judge Carlson said he wanted to first review a transcript of witness testimony before making his decision.

Trainauskas was found guilty of shooting Monica Timar in the back of the head with a Mossberg shotgun. He murdered her in a bathroom basement of his Acorn Ridge Home in January 2009.

Two days after Timar was reported missing, her body was found in the trunk of her Ford Mustang. She was wrapped in a comforter.

Trainauskas has consistently maintained his innocence.

Also during the hearing, Judge Carlson ordered the return of some of Trainauskas’ property, including a few thousand dollars prosecutors suggested might actually have been Timar’s, and a pair of swords.

Trainauskas also faces a charge of solicitation of murder. After he was arrested and jailed, he allegedly tried enlisting his cellmate to kill a prosecutor and pin the Timar slaying on someone else.
