Home Cut Donuts Arrest For Andrew Planeta: Chevy Silverado Truck Faces Police Forfeiture

JOLIET, IL — The Will County State's Attorney's Office is continuing to make life difficult for Joliet's 47-year-old west-side shooting defendant Andrew Planeta. In September, prosecutors successfully convinced Will County Judge Derek Ewanic to keep Planeta detained under the SAFE-T-Act. Now, Jim Glasgow is asking other judges to declare Planeta's 2023 Chevy Silverado truck a forfeited asset for the police.

The State's Attorney filed his civil forfeiture complaint Wednesday. Joliet Patch is the only news source that consistently covers the forfeiture filings at the Will County Courthouse.

According to the complaint, Planeta recklessly discharged his gun Sept. 16 while traveling from the 100 block of Joliet's Margaret Street to the Home Cut Donuts at 815 W. Jefferson St. That day, authorities say Joliet police officers Dehoyos and Gutierrez responded to Margaret Street after learning that Planeta fired a gunshot from his truck.

The officers found one shell casing in the street. In the neighborhood, prosecutors say officers spoke to Planeta's ex-girlfriend and her cousin, who told Joliet police they were inside when they heard the sound of a gun being shot. According to court documents, both women only heard one gunshot and one of the women saw Planeta's truck, the 2023 Chevrolet Silverado, driving off, going south on Margaret before turning on Morris Street.

A short time later, prosecutors say another Joliet officer found the Chevy Silverado at the Home Cut Donuts, with the engine still running, and the windows down. The officer saw a black handgun on the front passenger seat, according to police. Planeta was arrested inside the Home Cut Donuts and brought to the Joliet police station for booking.

Planeta refused to do any field sobriety tests, and "Officer Hernandez gave Andrew Planeta three tries to do the 20-minute observation period and each time Andrew Planeta would gag and act like he was puking," the complaint noted.

According to prosecutors, Planeta is a convicted felon and his driver's license was suspended in August 2024 for a DUI in Kane County. His license was later revoked this past May. Planeta also has previous DUI convictions in Will County from December 2011 and a DUI in DuPage County from 2006. His other previous convictions include illegal possession of a gun by a felon in 1995 and aggravated discharge of a gun, also from 1995.

As for the black semi-automatic Glock 23 handgun found inside Planeta's truck at Home Cut Donuts, Joliet police learned from Warrenville's Police Department that Planeta's gun was stolen from Warrenville on Nov. 28 2024, court documents reflect.

The forfeiture of Planeta's Chevy Silverado is now set for a hearing on Dec. 3. As for Planeta, he remains inside Will County's Jail and his next pretrial hearing for his criminal charges is in Courtroom 404 of Judge Vincent Cornelius on Thursday, Nov. 6.

The Will County State's Attorney's Office has charged Planeta with aggravated DUI, two counts of unlawful possession of a weapon by a convicted felon and aggravated driving while license revoked.
