If you’ve been paying attention to real estate headlines lately, you’ve probably seen a lot of debate around buyer representation. Are buyers required to have a buyer’s agent? Do they still “need” one?

The short answer: buyers have choices, and they always have. No one is legally required to hire a buyer’s agent to purchase a home. Some buyers feel confident navigating the process on their own, especially if they’re experienced. Others prefer support.

The key is understanding who represents whom. A listing agent’s fiduciary duty is to the seller. They must treat all parties fairly, but their job is to secure the best possible outcome for the seller. Many buyers choose their own agent because they want independent advice, access to private / off-market listings, help evaluating pricing and risk, guidance through inspections and contract terms, and a negotiator whose fiduciary duty is only to them.

One common misconception is that skipping a buyer’s agent automatically creates more negotiating power.
