No Charges In Fatal Portillo's Crash As Investigation Continues

The fatal crash that killed a 2-year-old boy and injured 12 others remains under review by the Kendall County State's Attorney's Office.

OSWEGO, IL — It's still undetermined if the driver involved in the fatal crash July 30 at Portillo's will be charged, Oswego police told Patch.

As of Friday, the case was still under review by the Kendall County State's Attorney's Office, police spokesperson Cathy Nevara said.

It'll be up to the office to determine whether to file charges or request that the Oswego Police Department investigate further.

"I do not have a timeline for when the review will be complete," Nevara said.

A 2-year-old boy, Finnegan McKee, was killed, and 12 others were injured when a 2011 Lincoln MKZ sedan, driven by a woman from Canton, Michigan, crashed through the entrance of the restaurant, 2810 Route 34. Oswego police believe the crash to be "a tragic accident," Patch reported.

The parents of the boy who died filed a lawsuit against Portillo's, seeking more than $50,000 in damages and calling for safety precautions to be "implemented at all businesses to prevent this from happening to anyone else."

Portillo's is just a few doors down from where a double stabbing occurred Oct. 22. Oswego police accused a 19-year-old man of fatally stabbing a delivery driver inside the restaurant before attacking a second man nearly two hours later in the parking lot, Patch reported.
