Councilman Smith Will Not Resign Pending Court Ruling

Anne Arundel County Councilman Peter Smith will continue as District 1's representative despite a court ruling that his predecessor, Daryl Jones, was removed "improperly."

Anne Arundel County Councilman Peter Smith (D-1st District), said Monday night that he would remain on the council despite a state court's ruling that his predecessor was removed from office improperly.

As questions were raised about the future of the District 1 seat, Smith read the following statement during Monday's council meeting. He provided the statement to Patch via email:

"For the last 16 months, I have been given an incredible opportunity to serve the communities and citizens of district 1.  I stated last year prior to my swearing in, that it doesn’t matter how long you’ve been somewhere, but what you are willing to sacrifice when you get there.  Anne Arundel County is my home.  It is where my kids attend school, where my wife and I work, and a county I want to remain vibrant for many years to come.  For this district and this county I am willing to give my all as a dedicated servant while recognizing the most important mission I have is to serve the people.  During this time, I have come to cherish the ability to make a difference in the lives of those who call Anne Arundel County home.  My goal while serving in this capacity has always been to be responsive and accessible.  To make decisions that are void of self preservation, and, represent in a manner that is honorable and professional. 

"E Hubbard once stated, “It does not take much strength to do things, but it requires a great deal of strength to decide what to do.” To that end, it is my decision to not resign as the Councilman for the 1st District and to allow the legal process to take its course.  This will allow a smoother process while not creating an unnecessary vacancy on the Council.  This county has been through so much over the last few years and I’m grateful that the clouds of friction will now be behind us. "
Smith was appointed to the 1st District seat in March 2012, following the ouster of former councilman Daryl Jones in January of that year. 

Jones was removed from the council just before leaving to serve a five-month sentence for not filing federal income taxes. The seat was declared vacant on grounds that he lived outside of his district while serving a prison sentence.

Earlier this month, the Maryland Court of Appeals ruled that the method in which the council oustered Jones from office was "improper."

Jones' case will next be heard by the Anne Arundel County Circuit Court.
