Dead Flies In Baking Powder Found in Silver Spring Restaurant Kitchen

Montgomery County food inspectors found three Silver Spring food establishments with critical violations of the health code.

SILVER SPRING, MD — Inspectors from the Montgomery County Department of Health and Human Services recently reported critical violations at three Silver Spring food establishments.

Although a fourth restaurant did not have any critical violations, an inspector identified numerous violations of best retail practices. These included finding dead flies in baking powder and standing water und the ice maker.

All Montgomery County licensed retail food establishments are inspected by the Licensure & Regulatory Services Program. Regular comprehensive inspections include evaluating an establishment's sanitation, maintenance and food service operations. These inspections include monitoring critical temperatures and food handling procedures.

"A Critical Violation means a food safety requirement that requires immediate correction," according to the health and human services website. "Failure for immediate correction results in cessation of some or all food operations or closure of the facility until violation is able to be corrected."

Complete Care of Wheaton

During a Dec. 4 inspection of the Complete Care of Wheaton at 4011 Randolph Road, an inspector with Montgomery County Health and Human Services found one critical violation. The center was out of compliance for its hot holding temperatures.

"Potentially hazardous foods observed hot holding at a temperature less than 135F.," according to the inspection report. The inspector noted that a corrective measure was taken while they were conducting the inspection.

Complete Care also had four violations of best retail practices. These violations are not as serious as a critical violation and the food establishment needs to correct them with 30 days.

The inspector noticed that the lid of the outside dumpster was open and the single service containers and coffee filters were stored with they food contact side exposed. Both of these violations were corrected, according to the report.

These were the remaining two violations of best retail practices that still had to be corrected:

  • "Floor observed soiled at floor/wall junctures in the storage room.
  • "Door gasket damaged on true 3 door reach in."

Dunkin Donuts

During a Dec. 4 inspection of the Dunkin Donuts located at 15509 New Hampshire Ave., an HHS inspector found two critical violations.

The restaurant was not keeping food separated and protected from adulteration, spoilage, and contamination, according to the inspection report. Also, employees were not properly washing their hands.

The inspector observed an "employee handling food without washing hands after handling money" and "croissant contaminated by unwashed hands."

As corrective measures, the employee was instructed on proper hand washing and the croissant was discarded.

The following violations of best retail practices and corrective measures were included in the inspection report:

  • "A Montgomery County Certified Food Manager not available. (Repeated violation)
  • "Allergen Awareness Certification not provided. Provide. (Repeated violation)
  • "Employee not wearing an effective hair restraint. Hair needs to be pulled up.
  • "Ice scoop with handle in contact with ice. Front service line.
  • "Stagnant dirty mop water stored in mop bucket. Discard after using mop."

Indochine Express

An HHS health inspector visited the Indochine Express located at 15416 New Hampshire Ave. and found one critical violation. The restaurant had failed to keep food separated and protected from adulteration, spoilage, and contamination.

"Raw potentially hazardous foods are stored with ready to eat foods in walk in," according to the report.

The restaurant also had a long list of violations of best retail practices. Here are the violations and suggested corrective actions the restaurant needs to make:

  • "Grinder and Mixer used are not approved commercial equipment. Remove.
  • "Hand sink completely blocked, food equipment stored in sink. Keep sink accessible at all times.
  • "Fly infestation observed. Clean drains throughout, work with exterminator to eliminate.
  • "Re-use of single service cans and containers observed. Repeat violation.
  • "Walk-in shelves with rust. Remove rust.
  • "Non food contact surfaces of wood holding unapproved grinder not clean. Exterior of walk-in unit dirty. Clean.
  • "Floors under fryer not clean with heavy grease.
  • "Interior of freezer not clean.
  • "Baking powder with dead flies in it.
  • 'Food items stored on the floor. Elevate at least 6 inches off the floor."

Kaldi's Social

An HHS inspector noted numerous violations of best retail practices during a Dec. 4 inspection at Kaldi’s School, which is located at 918 Silver Spring Ave.

The inspection report listed the following violations and corrective measures:

  • "No Certified Food Service Manager is observed on duty during this inspection. Provide a Certified Food Service Manager on every shift of operation.
  • "No Hazard Analysis Critical control Point Plan is observed in this facility. Provide a Hazard Analysis Critical Control Point Plan for all potentially hazardous food which requires time or temperature control for safety.
  • "No paper towel is observed at hand washing station at the front service area. Provide paper towel at all hand washing station. Provide a paper towel dispenser.
  • "No hot running water is observed at the hand washing station at the cook line.
  • "Provide hot and cold running water at all hand washing stations. Provide hot running water at the cook line 24 hours. Hot running water must be provided at all hand washing stations
  • "The hand washing station at the three part sink is observed removed. Replace the hand washing station in two days. A hand washing station must be provided in this food preparation area and three part sink area.
  • "Missing ceiling tile is observed over the three part sink. Replace the ceiling tile.
  • "Standing water is observed on the floor under the ice machine. Water is observed running into the restroom area and the customer seating area. Keep the floor free of standing water.
  • "Restroom doors are observed not self closing. Provide a self closing mechanism for the restroom door.
  • "The upstairs bar is observed with two dump sinks. One hand sashing station which was originally installed at the upstairs bar is observed removed. Dump sinks must not be used as a hand washing sink. Provide a hand washing station at the upstairs bar.
  • "Ice scoop in the ice bin at the upstairs bar is observed stored with the handle in contact with the ice. Store the ice scoop in an approved manner. Protect the food from contamination."

Kaldi's Social has 30 days to correct these violations.

The inspector also advised the food establishment that the downstairs and upstairs of the restaurant operate under a single license. Both the upstairs and downstairs needed to comply with all food laws and regulations.
