Michelle Carter is set to be released from prison this month, less than a year into her 15-month prison sentence for encouraging her boyfriend to kill himself. The Plainville woman will be released Jan. 23, according to the Bristol County Sheriff's office.

Carter was sentenced to 15 months in prison in February. She has earned time off for good behavior at the Bristol County House of Corrections, Boston 25 reported.

Carter was 17 when she convinced her 18-year-old boyfriend, Conrad Roy III, over the phone to get back into a truck filling with toxic gas. Prosecutors also uncovered a number of text messages of her encouraging him to take his own life. Carter was convicted of involuntary manslaughter.

The U.S. Supreme Court on Monday said it will not hear an appeal on her conviction, something her attorney called "unfortunate" in a short statement.

"Clearly many legal scholars and many in the legal community understand the dangers created by the unprecedented decisions of the Massachusetts courts," Joseph Cataldo said.

She was denied parole in September for what the Massachusetts Parole Board said was in part a "lack of empathy."
