Holliston Loses Suit to Block Condo Construction
Town planner fears groundwater contamination on "bird property."

Massachusetts’ highest court ruled against Holliston yesterday in lawsuit to block construction of 200 condos on Marshall Street after six years of legal action.
Residents and officials fear construction could contaminate the town’s ground water. The former illegal dumping site on Marshall Street, known as the "bird property," is home to polluted soil from decades of chemical waste.
While the site has been inspected by environmental agencies, Town Administrator Paul LeBeau said the town has “a concern with the difficulty of identifying all hazardous waste.” He fears construction could expose the dangerous chemicals in the site's soil to Holliston residents.

During the hearing, the site's developers promised to work with environmental agencies on issues including wetlands contamination and wastewater pollution.
The town spent over $190,000 on consultants, expert witnesses and legal fees, LeBeau said.
