Irving School Student to be Summonsed After Allegedly Battering Cop

A 13-year-old 220-pound Irving Middle School student will be summonsed to court for allegedly assaulting a Boston Police officer.

On June 11, around 2:30 p.m, a Boston Police officer met with an officer assigned to the school, needing assistance with the student in the cafeteria.

The student had been asked several times by staff and the school cop to stop writing on a cafeteria table and to go to the planning room, according to a Boston Police report. The school officer asked the student to give him the pen and to go to the planning room again, which the boy refused and said, "Why? It's not a big deal." 

The police officer allegedly told the student it would be wiser to go to class instead of dealing with possible legal issues of writing on the table. The boy allegedly said, "Am I supposed to be intimidated by a school cop?" The officer said that was not the point of him being there, and he asked him again to give him the pen, and if he refused to follow directions he would be arrested for vandalism.

Both officers then went to place handcuffs on the student, as the 13-years-old student is about 6' 2" and weighs about 220 pounds, according to a Boston Police report. 

A struggle ensued and the officers were able to get the student on the table and get his hand behind his back, and he stopped struggling. 

One of the officers got hit on the right side of his face near his eye and bruised his right knuckle. The other officer received cuts to his hands.

After calling for a transport to bring the student to the district to be booked, the officer spoke with the school's support staff and concluded that because the boy was only 13-years-old, and had been calm after the struggle, he could be released to his family. 

The family was told the boy needed a suspension hearing with the school, and the officer was going to summons him to the court.
