Is It Legal to Transfer Marihuana Overages in Royal Oak?

Patch reader Ted asks: "There's a sign in Royal Oak that reads 'Caregiver Overages Wanted.' I thought that wasn't legal."

To answer Ted's question, Patch  asked City Attorney Dave Gillam. Here's what he said:

"Your reader is absolutely correct.  Michigan courts have ruled that the only transfer of marihuana that is allowed under the Medical Marihuana Act is between a qualified patient and a caregiver who is affiliated with that patient through the State’s registry system.  The sale of excess marihuana is not permitted."

Calls to the phone number on the sign were not immediately returned and the sign has since been removed.
