Inver Grove Heights Man Sentenced After Admitting to Sex With Oakdale Minor

Maxx Austin Whitmire, 23, admitted to engaging repeatedly in sexual acts of with his then-14-year-old girlfriend.

An Inver Grove Heights man was sentenced to 15 years probation and 90 days in jail on Nov. 4 after being convicted of felony charges of third-degree criminal sexual conduct with a person between 13 and 16 years of age.

Maxx Austin Whitmire, 23, admitted to engaging repeatedly in sex acts with his then-14-year-old girlfriend, according to a court complaint. Whitmire was 21 when the couple started dating, the complaint says.

According to the complaint, the girl's parents caught the couple kissing in their Oakdale home on July 17, 2010, and ordered Whitmire to leave.

The girl later admitted to her parents that she and Whitmire—who met on Facebook—conducted a secret relationship for a year prior to being caught, according to the complaint. 

During an interview with Oakdale police, the girl said that she and Whitmire had been together approximately 15 times between July 2009 and July 2010 and that they had sexual encounters each time they met, the complaint stated.

Whitmire consented to a police interview on July 23, 2010, was arrested, and taken into custody.

On Aug. 6, 2010, a forensic examination of Whitmire's media devices revealed sexually explicit pictures of himself, which he admitted to having sent via email to his girlfriend, the complaint stated.

Whitmire was originally charged with distributing via electronic communication sexually explicit material to a child but was not convicted of the felony offense.

Whitmire's sentence also includes the following orders:

  • Register as a predatory offender;
  • Cooperate with computer monitoring software and/or random computer searches and searches of his internet capable devices;
  • Attend sex-offender treatment and aftercare;
  • Abstain from the use of all mood-altering chemicals, including alcohol;
  • Follow all standard terms and conditions of the sex-offender unit;
  • Have no unsupervised contact with minors unless approved by a therapist and supervising probation officer;
  • Have no contact with victim, her family, or their home;
  • Submit to and cooperate with polygraph testing, cooperate with transfer of probation to county of residence;
