Wayzata Man Charged With Failing To File, Pay $397K In State Taxes

ST. PAUL, MN — A Wayzata man faces multiple felony charges after authorities accused him of failing to file or pay state income taxes for several years, according to the Minnesota Department of Revenue.

The Hennepin County Attorney’s Office charged Kevin Patrick Mullen with five felony counts of failing to file individual income tax returns and five felony counts of willfully failing to pay income tax.

Prosecutors say Mullen failed to file returns or pay taxes for tax years 2019 through 2023, despite earning taxable income through his real estate business, Ideal Properties and Investments LLC.

Investigators said Mullen owed more than $397,000 in income tax for that period.

According to the complaint, Mullen knew of his obligation to file because he had submitted previous returns and had multiple contacts with the department about his prior debts.

When contacted by investigators in December 2024, Mullen admitted he hadn’t filed the missing returns and said he needed to “get back on track,” officials said.

While he eventually filed the returns in February 2025, the complaint also states he failed to submit returns for multiple years before 2019. In 2017, Mullen reportedly told the department he was preparing late filings dating back to 2008, but those returns were never filed.

Each felony tax charge carries a maximum penalty of five years in prison, a $10,000 fine, or both. Defendants are presumed innocent until proven guilty.

The Department of Revenue said it pursues criminal cases to ensure tax laws are enforced fairly.
