Stillwater Inmate Charged With Felony For Spitting in Guard's Face

If convicted of the charge against him, Luis Alberto Ruvalcaba-Herrera, 23, could remain incarcerated until 2018.

An inmate of the Minnesota Correctional Facility at Stillwater is facing three more years on his sentence and a $6,000 fine after admitting to spitting in the face of a guard back in August. 

According to a criminal complaint filed at the end of Oct.: 

Luis Alberto Ruvalcaba-Herrera, 23, was charged with felony fourth-degree assault after spitting in a guard's face because he was angry that the guard placed him on investigative restriction for abusive behavior.

The alleged incident happened on Aug. 16 after Ruvalcaba-Herrera learned of his restricted privileges during a routine security check. 

Ruvalcaba-Herrera was sentenced to five years in prison in July 2010 after being convicted of felony first-degree assault.

After months of legal maneuvering, Ruvalcaba-Herrera is scheduled to appear in court on Jan. 4, 2012.  

If convicted of the charge against him, Ruvalcaba-Herrera could remain incarcerated until 2018.
