Convicted NH Burglar Considered ‘Armed And Dangerous,’ Has Active Warrant In Massachusetts: Corrections

CONCORD, NH — The New Hampshire Department of Corrections is asking for the public’s help in finding a felon accused of absconding from supervision after being released on parole.

Brian Gerard Mercier is white, 54, about 5 feet, 8 inches tall, and weighs about 175 pounds. He has brown hair and brown eyes. Investigators said he sometimes uses the aliases “Daniel Brendan” or “Brian Brandon.” The New Hampshire Parole Board issued the warrant against him.

“Mercier was released on parole and has absconded from parole on or about Aug. 9,” according to investigators. “Mercier has a criminal history that includes multiple burglaries, burglary with a weapon, breaking and entering daytime and night, and conduct after an accident.”

The alert issued an “armed and dangerous” warning to his fugitive status.

Mercier’s criminal history “spans across multiple states, including New Hampshire, Massachusetts, and Florida,” an alert stated. Investigators said he was last known to be living in Billerica, MA. There, officials said, he has another pending arrest warrant.

According to superior court records, Mercier was charged with burglary and attempted burglary in Hudson in 2000, but the four counts were dismissed.

Jump ahead to August 2021, when Mercier was accused of burglary and criminal mischief in Salem, and then of burglary and criminal mischief, two counts each, in Windham. In December 2021, Mercier was charged with two counts of burglary in Nashua.

In July 2022, Mercier pleaded guilty to the two Nashua charges and received two three-to-six-year prison sentences, one suspended for five years, with 214 days of time served credit.

Two days later, also in July 2022, he pleaded guilty to the Salem burglary charge, and the two burglary counts out of Windham. Mercier was sentenced to three three-to-six-years in prison sentences with 195 days of time served concurrently with one sentenced suspended for five years. Two weeks later, the Salem sentence was amended to include $347.15 restitution.

In December 2023, Mercier’s sentences for the Nashua case were amended with the minimum sentence suspended, with restitution to be determined.

Mercier was given work release in July 2024.
