Beach Official's Trial Still Not Rescheduled After Evidence Tossed

A decision will be made soon on the trial against Jude David, whose attorney recently secured the dismissal of a key piece of evidence.

Hampton District Court staff say a firm date still has yet to be set for a driving while intoxicated trial against the chairwoman of the Hampton Beach Seafood Festival, although staff say it's possible one may be scheduled within "the next week or so."

Jude David, who also serves as the state parks facilities manager for Hampton Beach, faces one count each of DWI and conduct after an accident for allegedly hitting a parked car at about 11:03 p.m. on Oct. 13 at the 401 Tavern.

The trial has been delayed multiple times, including once on Feb. 20 after the defense filed a motion to suppress the results of a breathalyzer test conducted on David after the alleged incident. A judge granted that motion on Feb. 22, effectively tossing out a key piece of evidence in the Hampton Police Department's case.

David has pleaded not guilty to the charges. If convicted on the Class B misdemeanors, David won't face jail time, although she could be assessed various monetary penalties and could lose her license, according to state statutes.
