Londonderry Woman Sues Stumble Inn After Falling
A Londonderry woman has filed suit against Stumble Inn Bar and Grill after falling and being injured there in 2016.
LONDONDERRY, NH — A woman is suing Stumble Inn Bar and Grill after falling there and being injured three years ago. Brittany Pescia of Londonderry has filed suit against the establishment last week at Rockingham County Superior Court. According to the complaint, Pescia was trying to enter Stumble Inn Bar and Grill on April 8, 2016, as two men were exiting the building and began fighting, causing Pescia to fall. She "sustained severe personal injuries," including a spinal injury, cerebral concussion, mild traumatic brain injury, post-concussion syndrome, states the complaint. Pescia also lost work wages as a result at being injured, it states.
Pescia filed the civil suit Thursday against the 20 Rock LLC, which owns Stumble Inn Bar & Grill. The business is located at 20 Rockingham Road, Londonderry. The complaint claims negligence, saying that the entrance of the establishment was too narrow to allow for two men to exit the building while another customer was entering. It also claims negligent service of alcohol, alleging that Stumble Inn Bar and Grill served customers that were already intoxicated, and negligent maintenance of premises, alleging the business failed to take reasonable steps to prevent the risk posed by the assault.
In lawsuit, filed through her attorney Andrew Myers of Derry, Pescia requested a trial by jury, asking that the defendant pays for all damages. As of Tuesday, no hearing has yet been scheduled on this case at Rockingham County Superior Court.
