What if New Londonderry Town Manager Decides to Run for Office?

Former gubernatorial candidate Kevin Smith was hired by the town this month.

The town of Londonderry recently hired former gubernatorial candidate and Litchfield resident Kevin Smith as its new town manager.

According to a report by the Londonderry Times, Smith has specific clauses in his contract related to a departure for a political office run.

Through information obtained via the Freedom of Information Act, the paper determined the following clause:

"In the event he announces that he is running for political office while employed as Town Manager or within 120 days of his last day of employment as Town Manager following his resignation, Smith shall pay to the Town a lump sum cash payment equal to two months’ aggregate salary, representing liquidated damages, as any calculation of damages would be difficult to ascertain.”

Smith must also give at least 60 days' notice in the event that he wishes to resign.

Last week, Smith told Londonderry Patch that he has no plans to run for office or return to politics in another capacity sometime in the foreseeable future.
