Man Arrested for Lying About Possessing Gun

Police say man was supposed to surrender firearm as part of a temporary restraining order.

A Merrimack man was arrested Thursday for lying to police about the whereabouts of a gun he was supposed to surrender to authorities as part of a restraining order.

Scott Tierney, 33, of 86 Turkey Hill Road, Merrimack, was charged on a warrant for obstructing government operations.

Merrimack Police said they served a temporary restraining order issued out of the 7th Circuit Family Court, Rochester, to Tierney on Tuesday, March 12. At the time he was expected to hand over any firearms in his possession to an officer.

Police say he told them another person was in possession of his gun, however they later learned that was not true. Tierney was released on $2,000 personal recognizance bail and is due in the 9th Circuit Court, District Division in Merrimack on March 28.

Merrimack Police took custody of the firearm.

Also arrested recently were:

Alek Viljanen, 20, of 11 Seaverns Bridge Road, on a charge of breach of bail conditions. Police say Viljanen turned himself in at the Merrimack Police Department for an active warrant for his arrest stemming from an incident that began on March 5 when Viljanen was arrested for simple assault for punching a family member on Seaverns Bridge Road. He was arrested that night and charged with one count domestic simple assault. He posted bail, and agreed to bail conditions that included staying away from the property where the alleged assault occurred. On March 9, it was reported to the police that, Viljanen entered the property. He was released on $1,000 personal recognizance bail and ordered to appear in the 9th Circuit Court, District Division, in Merrimack on March 13 to answer to the charge.

Leonard Ciesluk, 60, of Duck Pond Lane, Merrimack, was arrested on a charge of simple assault. On Tuesday March 12, Merrimack Police responded to a residence in the Herring Cove Complex for the report of an assault that had just taken place. Responding officers spoke with a victim inside the home who said Ciesluk, a family member, punched them in the face during an argument. Ciesluk was was released on $2,000 personal recognizance bail and was scheduled for arraignment in the 9th Circuit Court, District Division, in Merrimack on Wednesday March 13.

Derek W. Kerrins, 30, of 11 Bates St., Methuen, Mass., on a  bench warrant for failure to appear on a Possession of a controlled drug offense. Police say Kerrins turned himself in at the Merrimack Police Department on March 11 for the warrant which stemmed from  trial he did not appear for stemming from Jan. 24, 2008.  Kerrins was released on $2,000 cash bail. He is scheduled to appear in the 9th Circuit Court, District Division, in Merrimack on March 13.

Mark McCarty, 42, 189 Laurel St. No. 2, Manchester, was charged with possession of marijuana on March 8. Police responded to 27 Mitchell Street for the report of a suspicious vehicle at the residence. Upon arrival, police say they made contact with a subject, later identified as McCarty, and conducted a brief investigation. As a result of the investigation police found McCarty to be in possession of marijuana. He arrested and released on $2,500 personal recognizance bail and into the custody of the Hillsborough County Sheriff's Department on an outstanding warrant on an unrelated and unspecified charge. He is scheduled to appear in the 9th Circuit Court, District Division, in Merrimack on March 28 on the possession charge.
