Third Strike for Merrimack Man Means Felony Charge

A third strike upgraded a misdemeanor receiving stolen property charge to a felony for a Merrimack man in possession of a stolen wallet over the weekend, police say
Dylan Provost, 21, of 20 Lamson Drive, Merrimack, was arrested on July 27, charged with receiving stolen property – a felony, operating a motor vehicle without proof of financial responsibility, disobeying a police officer and operating a motor vehicle without a valid license.
Provost's car was spotted by police in the parking lot of a closed business at 3:10 a.m. on Saturday. After checking the building and surrounding area, and coming up with nothing, they decided to wait and watch from a distance.

It was a short time later that police spotted Provost, a person known to them, returning to his car from behind the building. Provost left and headed north on Daniel Webster Highway. Police say they ran Provost's license place and learned he didn't have a valid license and stopped him near Elm Street.
According to Merrimack Police, when the officer approached Provost he told him that he did not have a license and gave him a false name and date of birth. Provost was arrested for disobeying a police officer.

In the vehicle a wallet was found that did not belong to Provost and the owner of the wallet was contacted and told police that Provost should not be in possession of their wallet.
At the Merrimack Police Station, Provost was charged with the four crimes. Police say the receiving stolen property charge was upgraded to a felony level due to Provost being previously convicted of two other thefts.
He was released on $7,500 personal recognizance bail and ordered to appear in the 9th Circuit Court, District Division in Merrimack on Aug. 19 to answer to the charges.
