Man Charged with Felony Assault in Weekend Stabbing

Police have charged Walner Rodriguez following an early morning fight at the Polish American Club.

Police have charged Walner Rodriguez, 19 of 501 Brook Village Road, Apt. 1, Nashua, with three counts of first-degree assault in a stabbing Sunday morning that left one man injured.

According to a police narrative:

On May 12, 2013, members of the Nashua Police Department Uniformed Field Operations Bureau arrested a Nashua resident for three counts of First Degree Assault, Class A Felony. Walner Rodriguez, 19, of 501 Brook Village Road, apartment #1, Nashua, was arrested at approximately 1:02 a.m.

On May 12, 2013 at approximately 12:35 a.m. uniformed officers responded to the Polish American Club on School Street for the report of a large disturbance. Upon arrival, the officers encountered a large group of individuals actively fighting in the middle of School Street. Among the group of individuals, the officers located an adult male victim who had been stabbed. The victim was transported to the Southern New Hampshire Medical Center for treatment. His injuries are non-life-threatening.

According to court documents, Rodriguez allegedly used a keychain with a pointed-tip bullet on the end to stab Tavarez-Brito in the left arm, chest and back.

An on-scene investigation by the uniformed officers identified Rodriguez as being responsible for the stabbing. He was subsequently placed under arrest. The investigation was furthered by detectives of the Criminal Investigative Division.

Court documents include testimony from more than a dozen people who testified that a verbal fight originating inside the club resumed outside the club between two groups of people, erupting into a brawl.

Each Class A Felony is punishable by seven to 15 years in the New Hampshire State Prison, exclusive of fines. Rodriguez was released on conditional $50,000 cash bail following his arraignement May 13. He was ordered to have no contact with Tavarez-Brito.

Also arrested in connection to this incident was Argenys Rodriguez, 20 of 501 Brook Village Road, Nashua, brother of Walner Rodriguez.

Argenys Rodriguez is charged with disorderly conduct, assault on a police officer and resisting arrest, all class A misdemeanors. While responding to the disturbance outside the Polish American Club, officers made contact with Argenys Rodriguez and warned him to stop engaging in disorderly behavior to include yelling and attempting to fight with others. Argenys Rodriguez continued his disorderly behavior and additionally pushed an officer in the chest. Officers attempted to place Argenys Rodrigues into custody. However he pulled away from officers and refused to comply with lawful orders.

Each class A misdemeanor is punishable by up to one year in the County House of Corrections, exclusive of fines. Argenys Rodriguez was bailed and will appear in the 9th Circuit Nashua District Court on May 30th.
