A Derry man faces trial on two charges in connection to a heroin bust in Salem.
Timothy Lee Perkins, 24, of 26 Lawrence Road, was indicted this month on a Class B felony count of falsifying physical evidence as well as one count of possession of a controlled drug.
The indictments allege that Salem police found Perkins — who was convicted in Derry District Court on May 8, 2008, on a drug offense — was in possession of heroin on July 16.
Perkins was indicted on the evidence charge because he allegedly "concealed or removed a bottle cap containing heroin" by "throwing the cap into the grass and away from police" during a police investigation, according to the indictments.
An indictment is not an indication of guilt or conviction; rather, it means a grand jury believed there was sufficient evidence to warrant a trial.
