Three officers were involved in the incident – Officers Shane Mirisola and Chris Van Hirtum of Windham an Officer Eugene Stahl of Pelham.

All three officers shot at Hebert's vehicle at the end of the pursuit after Hebert attempted to run down the two Windham officers, who were both out of their vehicles.

Hebert's was transported to Parkland Medical Center, where he had a small puncture wound to his lower calf, small puncture wound to his upper right back, swelling around one of his eyes and fragments of a bullet under his scalp in the rear of his head.

New Hampshire Attorney General Michael Delaney reported in December that the officer-involved shooting was a legally justified use of deadly force.

In his report, Delaney gave a lengthy narrative on the chase from start to finish, which started after Stahl attempted to pull Hebert over after flagging him for traveling 10 miles per hour over the posted speed limit.

The three criminal mischief charges stem from Hebert's damaging of two cruisers, one from Pelham and one from Windham, as well as the fence and lawn on Lowell Road.

The aggravated DUI charge is due to Hebert's increasing his speed in an attempt to elude pursuing officers.
