Judge's Decision On Kushner Cos. Apartment Plan Still Pending

Four residents filed a lawsuit seeking to overturn the ordinance, which allows up to 700 residential units on the site

EATOWNTOWN, NJ - Planning Board meetings for Kushner Cos.' "The Heights at Monmouth," part of the redesign of the Monmouth Mall, are slated to start on March 5, according to a report in app.com.

The company submitted a site plan application back in December. The plan - a mix of residential and commercial space - was first introduced to the public in January 2016.

A portion of the plan calls for three buildings, for a total 340 one-bedroom, 342 two-bedroom and 18 three-bedroom apartments. But first, Monmouth County Assignment Judge Lisa Thornton must rule on a lawsuit filed by four residents who are trying to stop the development.

The residents are hoping the judge will overturn the ordinance, which allows up to 700 residential units on the site. Testimony in the lawsuit ended in July.

Kushner Cos. is owned by the family of President Donald Trump's son-in-law and senior adviser Jared Kushner. The real estate giant partnered with Rouse Properties in May 2017 on a 50-50 deal to redevelop the mall.

The site plan calls for space to "house a vibrant mix of shopping, dining, entertainment, leisure as part of 24/7 mixed-used center ... with the addition of residential space."
