Police say 2 men were uncooperative, and 1 spit on officers and became aggressive.

LONG VALLEY, NJ — Two men face several charges after being uncooperative during a DWI arrest, with one of the men accused of spitting on police officers, Washington Township police said.

Donald Phillips, 41, of Hickory, North Carolina, and Daniel Davinci, 32, of Hackettstown, both face several charges stemming from an early-morning incident on Dec. 31. Police say the men were stopped in front of the Schooleys Mountain Fire House with a flat fire around 1 a.m. when police found them.

Phillips, who police say was driving, allegedly smelled like alcohol and refused to answer any questions. Police asked him to complete field sobriety tests, and he allegedly refused. He was placed under arrest and taken to police headquarters.

Phillips was charged with DWI, refusal to provide breath samples and reckless driving. Davinci was charged with criminal mischief and resisting arrest.
