Footage Released In Fatal E-Bike, Police Car Collision In Middletown

The Attorney General released footage of the October 2025 crash on Rt. 36, when an Atlantic Highlands Police officer hit a man on an e-bike.

MIDDLETOWN, NJ — On Thursday, the New Jersey Attorney General released video footage of a fatal crash that happened in October on Rt. 36 in Middletown, when an Atlantic Highlands Police officer, driving a marked patrol car, hit a man riding an e-bike.

The man riding the e-bike was airlifted to Jersey Shore University Medical Center in Neptune, where he died of his injuries nine days later. Until this week, the e-bike rider and the police officer were never identified by name. The Attorney General announced it was Henry Phillips, Jr., 73, a resident of Atlantic Highlands, who was killed, and Officer Timothy Funk of the Atlantic Highlands Police Dept. who hit him.

Phillips’s family were given an opportunity to review the recording prior to its public release. To date, no criminal charges have been filed against the Atlantic Highlands Police officer.

The crash happened at 1:00 p.m. on October 10, 2025: While driving a marked police vehicle, Funk was travelling on Orchard Avenue and stopped at a red traffic light at the intersection of Orchard Avenue and Rt. 36.

Phillips was riding an e-bike southbound in the northbound lane of Rt. 36, the Attorney General said.

The e-bike and marked police vehicle collided after Officer Funk made a right turn on red.

Phillips died at Jersey Shore University Medical Center on October 19, 2025.

Because this was a fatal encounter with a law enforcement officer on duty, the death remains under investigation by the Attorney General. The recording is being released pursuant to policies established by the Attorney General’s Office in 2019 designed to promote the fair, impartial and transparent investigation of fatal police encounters.
