25th Amendment Resolution: How Your U.S. Representative Voted

U.S. Representative Mikie Sherrill helped pass a resolution asking Vice President Mike Pence to remove President Donald Trump from office.

PARSIPPANY, NJ — The U.S. House of Representatives passed a resolution asking Vice President Mike Pence to invoke the 25th Amendment to remove President Donald Trump from office.

U.S. Representative Mikie Sherrill, who represents New Jersey's 11th district, voted yes on the resolution. The move was no surprise one for Sherrill, a Democrat that has been a vocal critic of Trump throughout her first term in office.

"I think he should have already resigned, due to his recent actions," Sherrill said in a Facebook live event Tuesday evening before the vote. "We need to make sure he doesn't have access to intelligence because I believe this president will do it for personal gain." You can view her complete address below.

The resolution, which passed 223-205 along party lines with Republican Adam Kinzinger joining, states that Trump “widely advertised and broadly encouraged” protests that led to last week’s violence and insurrection at the Capitol building, according to a report from NPR. It urges Pence to invoke his powers to declare Trump unfit for office “immediately” and assume all powers and responsibility of the presidency.

"What took place (the Capitol riot) is absolutely intolerable and unacceptable," Democrat Rep. Jamie Raskin of Maryland said in support of the resolution. It is "very clear the president did not discharge the proper duties of office."

Rep. Tom Cole, an Oklahoma Republican, called the resolution "misguided and inappropriate."

"The majority is asking the House to assume a power it does not have," Cole said, pointing to the power of invoking the 25th Amendment that lies with "the vice president and Cabinet alone."

Sherrill was among the Democratic lawmakers calling for Trump's removal from office two day after the riot at the Capitol. In a statement, she along with fellow Democrats blamed Trump for inciting the Jan. 6 riot following a Pro-Trump rally protesting the results of the Nov. 3 general election. The rally was held the same day Congress was scheduled to certify the election results and confirm Joe Biden as the next U.S. president.

"Citizens have a constitutional right to protest but what we saw at the Capitol was rioting, trespassing, and violence," Rep. Sherrill said in a statement. "Those who participated should be prosecuted to the full extent of the law. The massive security failure at the Capitol complex must be investigated."

If Pence does not respond to the resolution within 24 hours, according to several reports, leaders in the House plan to begin impeachment proceedings.

If that occurs, Trump would become the first president in United States history to be impeached a second time. To be removed, he will need to be convicted by the Senate.

House members were meeting in committee on the 25th Amendment resolution at 11 a.m. ET. A vote is set on the full House of Representatives floor later on Tuesday, according to a report from CNN.

Trump is eight days away from the end of his term, with President-elect Joe Biden set to become America’s 46th president on Jan. 20.

Essex County - Bloomfield (split with 10th), Caldwell, Cedar Grove, Essex Fells, Fairfield, Livingston, Montclair (split with 10th), North Caldwell, Nutley, Roseland, Verona, West Caldwell, West Orange (split with 10th)

Passaic County - Bloomingdale, Little Falls, North Haledon, Pompton Lakes, Totowa, Wanaque, Wayne and Woodland Park

Sussex County - Byram, Hopatcong, Ogdensburg, Sparta and Stanhope
