After learning that Herman had passed, Sgt. Heather Kovar (who oversees the police department’s Traffic Safety Unit) consulted with the Monmouth County Prosecutor’s Office, Frazee said. It was recommended that no criminal charges be filed.

The driver of the vehicle, Emilia Vasquez De Menjivar, was issued several motor vehicle violations as a result of the incident, which is pending court action, Frazee said.
