Resentencing Ordered for Drunken Driver Who Killed Teens

A Dover man who was convicted of manslaughter following the 2006 deaths of two teenagers walking on Kinnelon Road will be resentenced, even though an appeals court panel upheld his sentence on two counts of manslaughter for the charges on Tuesday, according to a news report.

Eugene Baum's case was sent back to Supreme Court in Morristown, although he was initially sentenced in 2010 to two consecutive 20-year prison terms, according to the Star-Ledger.

Mayada Jafar, 15, of Kinnelon and Athear Jafar, 16, of Jefferson, were walking on Kinnelon Road toward the Kinnelon Clearview 11 when Baum struck the cousins from behind. His blood alcohol level was about four times the legal limit at the time, the newspaper reported.

The appeals panel decided Tuesday to order a resentencing on Baum after a judge said the court mistakenly counted parts of the crime as "aggravated," the Ledger reported.
