ALBANY, NY - District Attorney P. David Soares announced today that several jury trials concluded in Albany County Court in recent weeks.
On September 9, 2021, OCTAVIO RIVERA, 50, of Albany, was found guilty after a jury trial of (1) Count of Burglary in the Second Degree, a Class C Violent Felony, before the Honorable Peter A. Lynch in Albany County Court.
The jury concluded that on November 27, 2018, at approximately 2:30 A.M., RIVERA unlawfully entered an occupied apartment on Quail Street in the City of Albany belonging to several UAlbany students. While inside, RIVERA stole several laptops from the residence.
Due to RIVERA’s potential status as an eligible persistent violent felon, he faces up to 25 years to Life in State Prison when sentenced on November 8, 2021.
Assistant District Attorney Michael Shanley of the Major Offense Unit handled the prosecution of this case.
Additionally, on September 10, 2021, DAVID MILEY, 23, of Albany, was found guilty after a jury trial of (1) Count of Attempted Murder in the Second Degree, a Class B Violent Felony, and (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Violent Felony, before the Honorable Andra Ackerman in Albany County Court.
The jury found that on August 2, 2020, at approximately, 9:20 P.M., MILEY shot a 24-year-old man at close range while in the area of Cortland Place and State Street in the City of Albany. The man was treated for his injuries and survived.
MILEY faces up to 25 years in State Prison when sentenced on November 12, 2021.
Assistant District Attorney Megan Spillane of the Street Crimes Unit handled the prosecution of this case.
Also, on September 17, 2021, JAVIS THOMAS, 29, of Albany, was found guilty after a jury trial of (1) Count of Criminal Possession of a Weapon in the Second Degree, a Class C Violent Felony, before the Honorable Roger D. McDonough in Albany County Court.
The jury found that on January 29, 2019, THOMAS was in illegal possession of a handgun. An off duty police officer observed THOMAS shoot a round from this weapon while in the parking lot of 255 Patroon Creek Blvd. in the City of Albany. THOMAS discarded the weapon and fled the area. Thankfully no one was injured during the incident. Police were able to recover the weapon.
THOMAS faces up to 15 years in State Prison when sentenced on October 29, 2021.
Senior Assistant District Attorney Joseph Brucato and Assistant District Attorney Marissa Olsen handled the prosecution of this case.
