Lawsuit Against Saint Mary's Hospital Has Been Knocked Out

The Weeks Woodlands Association has lost their appellate court case against Saint Mary's Hospital on a techinical knock out, the group's president said this week.

The civic group has bitterly opposed the expansion of the facility since 2010, claiming that community input was not sought for a 168,538 square foot expansion of their Children's Hospital.

The expansion would not have added any beds, but is intended to make the hospital stays of ailing children more private, and allow for parents to comfortably sleep by their childrens' side, according to the Queens Courier.

According to the paper, the Association first went to court in August of 2010, months before construction on the project began, because and executive with Turner Construction—which oversees the project—refused to honor any quiet hours, including early mornings and Sundays.

WWA President Tim Vance also alleged that Turner's Vice President told him, “We are going to make your lives miserable," a claim which the paper could not independently verify.

"We started out litigation before they started construction, but the judges said ‘you win on the law, but you lose on a technicality," said Vance. That technicality, he said, was that the project has been largely completed.
