Queens Man Charged With Attempted Murder For Firing At Cops: DA

A man accused of shooting at police responding to a domestic incident at his home Sunday has been charged with attempted murder.

COLLEGE POINT, QUEENS — A College Point man who shot at police responding to a domestic violence incident at his home over the weekend has been charged with attempted murder, the Queens District Attorney's Office announced Tuesday.

Rodolfo Montero, 25, was locked up without bail after he surrendered to police following a brief standoff Sunday at a home on 125th Street, prosecutors said. If convicted, he faces a sentence of up to life in prison.

Montero is accused of firing multiple shots at officers from the NYPD's 109th Precinct when they showed up at the home for a 911 call about a domestic assault.

According to the charges, Montero had gotten into an argument earlier that day with the 20-year-old mother of his child and choked her. His mother, who was there at the time, tried to intervene, but he slapped her in the face.

Later the same day, Montero punched the woman in the face in front of their 1-year-old daughter, prosecutors said.

He pulled out out a gun and told her, "I am going to kill you."

The woman grabbed their child and ran out of the apartment with Montero's mother, according to prosecutors.

Police showed up about 4:30 p.m. to gunfire, with bullets flying from the window of the home and striking a car. They took cover behind a vehicle until he eventually surrendered. No one was injured.

Officers searching the home afterward discovered a loaded AK-47 assault rifle inside, according to prosecutors.

Montero's defense lawyer couldn't immediately be reached for comment.
