Daniel Penny Indicted In Jordan Neely's NYC Chokehold Death: Reports

A grand jury indicted the Long Island former Marine on a manslaughter charge Wednesday, according to reports.

NEW YORK CITY — Grand jurors have indicted Daniel Penny in the chokehold death of Jordan Neely on a New York City subway, according to multiple reports.

Penny, 24, of Long Island, was indicted Wednesday on a manslaughter charge more than a month after Neely died in a chokehold on the floor of a Manhattan F train, sources told NBC News.

The Manhattan District Attorney’s office declined multiple outlets' requests for comment.

Penny’s lawyer told the Daily News he hadn't known his client had been indicted and hung up the phone.

Penny himself has said he acted in self-defense when Neely began shouting at fellow straphangers.

"He was yelling in their faces saying these threats," Penny said in a series of videos published by his attorneys. "I just couldn’t sit still.”

But those who knew Neely say he was a loving man and a talented performer who shouldn't have been killed because he faced mental health challenges.

"He always made people smile," said Manhattan Borough President Mark Levine. "He deserved help, not to die in a chokehold on the floor of the subway."

“Jordan was a good man,” Neely's father told the Daily News. "He always had a (temper), but he never used to hurt anyone ... He wasn’t bad. He was beautiful.”
