Nassau Man Was Drunk With Children In SUV During Crash: Police

The children were 12 and 13 years old; no one was injured, Nassau police say.

WILLISTON PARK, NY — An Albertson man was charged with driving while intoxicated under Leandra’s Law on Friday night, Nassau police said.

Ben Abraham, 38, was driving a gray 2016 Toyota 4Runner with two juvenile passengers, ages 12 and 13, when he was involved in a crash at around 6:30 p.m. in Williston Park, police said, adding that the SUV struck a parked vehicle on Horton Highway.

Officers saw Abraham with glassy eyes and the smell of alcohol emanating from his breath, and when officers conducted a Standard Field Sobriety Test, there were positive results and he was placed under arrest without incident, police said.

The vehicle was impounded and the juveniles were both released into the custody of a family member, police said, adding that no injuries were reported.

Abraham was charged with two counts of aggravated driving while intoxicated under Leandra’s Law, two counts of endangering the welfare of a child, and multiple Vehicle and Traffic Law violations.

Leandra's Law is named after Leandra Rosado who was a passenger in a car that was driven by an impaired driver and she died. It makes the offense of driving with a child under 16 an automatic felony.

He will be arraigned Saturday in First District Court in Hempstead.
