Village of Ossining Police received a complaint of a car blocking the roadway and came upon a man asleep at the wheel, apparently drunk, who was already wanted for failure to appear in court for another DWI charge.
Lt. William Sullivan said the 30-year-old State Street man was found on Ellis Place last week. He had a bench warrant out for his arrest when police again charged him with driving while intoxicated along with aggravated unlicensed operation of a vehicle.
"He was wanted for DWI and got DWI at the time of his arrest," Sullivan said. Since he hadn't been convicted -- or appeared in court yet -- for the first offense, this remains a misdemeanor offense.
Sullivan said if the keys are in the ignition, even if the driver is asleep and hasn't been witnessed driving, it can be considered DWI.
