RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Minutes of the November 1, 2011 Regular Meeting as presented.
B. Approval of Voucher Detail Report
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Voucher Detail Report dated November 15, 2011 in the amount of $_________
C. Authorization to Advertise for Bids – Contract REC-11-09, Installation of Donated Tennis Lighting at Nelson Park
RESOLVED, that the Village Clerk is authorized to advertise for bids for Contract REC – 11-09, Installation of Donated Tennis Lighting at Nelson Park, to be returnable to the Office of the Village Clerk.
D. Declaration of Certain DPW and Police Vehicles as Surplus
RESOLVED, that the Board of Trustees of the Village of Ossining hereby declares the following vehicles as surplus equipment and authorizes their disposal in accordance with New York State law by sale or otherwise “as is”:

E. Authorization for Village Participation in Energize Northern Westchester Program
WHEREAS, the Town of Bedford, as lead municipality, and the Northern Westchester Energy Action Consortium, as inter-municipal partner with Bedford, have been awarded significant funding by both NYSERDA and the US Department of Energy to build an effective residential energy efficiency program that uses the high quality standards of the state’s Home Performance program combined with activation of local trusted sources for word-of-mouth outreach; and
WHEREAS, the Village Board of the Village of Ossining wishes to participate in the Energize Northern Westchester Program currently being piloted in the Town of Bedford, in order to extend the benefits of this residential energy efficiency program to the residents throughout the Village of Ossining; and
WHEREAS, the success of the Energize Northern Westchester Program requires local community participation in order to maximize the outreach in driving demand for energy upgrades of homes; and
WHEREAS, the Energize Northern Westchester Program will make resources, including staff and print and online materials, available to Consortium member municipalities that agree to undertake the Energize Program including but not limited to marketing collateral, a municipality website, and a performance tracking system.
NOW, THEREFORE BE IT RESOLVED: that the Village of Ossining Board of Trustees hereby adopts the Energize Partnership Pact, which states as follows:
Energize Northern Westchester and the Village of Ossining will work together to identify the key community resources, to wit, a Municipal Energize Liaison, Energize Champions, and Local Trusted Sources, to support the short and long term success of the Energize Ossining Program.
BE IT FURTHER RESOLVED: The Village of Ossining Board of Trustee authorizes the Mayor, in concert with the Village Manager, to appoint a Municipal Energize Liaison or Liaisons from among municipal staff or civic volunteers, with the understanding that the Liaison/s will serve as the chief point of contact between the Energize Northern Westchester staff and the Village of Ossining and its residents and civic associations and groups interested in promoting residential energy efficiency; and
BE IT FURTHER RESOLVED: The Liaison will work with the Energize Northern Westchester staff to identify Energize Champions, who will be homeowners in the community who have already undergone a Home Performance energy assessment and implemented energy upgrade to achieve savings, and whose role will be to assist the Liaison in identifying local civic groups, both formal and informal, also known as Local Trusted Sources, whose members may be interested in learning about residential energy efficiency; and
BE IT FURTHER RESOLVED: The Liaison and local Champions will collaborate with the Energize Northern Westchester staff in opening doors with civic groups for presentations about the Energize Program information, and any other outreach methods that the Municipal Liaison, Champions, and Local Trusted Sources may find effective in tailoring the Energize Program to this municipality.
F. Call for Public Hearing on Introductory Local Law 5, 2011
WHEREAS, the Board of Trustees of the Village of Ossining is considering adoption of a proposed local law to provide for the flexibility to override the tax levy limitations established by General Municipal Law Section 3-c should the need arise; and
WHEREAS, pursuant to New York State Law, the Board of Trustees shall hold a public hearing on the proposed local law during which the public shall have the opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Ossining hereby calls for a public hearing on Introductory Local Law No. 5, 2011, a local law providing the flexibility to override the tax levy limitations established by General Municipal Law Section 3-c to be held on December 6, 2011, at the Birdsall/Fagan Police Court, 86-88 Spring Street, Ossining, New York at 7:30 p.m. during which the public shall have the opportunity to be heard on such local law; and
BE IT FURTHER RESOLVED THAT Introductory Local Law No. 5 shall be available for public review at Village Clerk’s Office, Village Department of Planning, and on the Village of Ossining website at www.villageofossining.org until the respective closes of business on December 6, 2011; and
BE IT FURTHER RESOLVED THAT the Village Board directs all requisite notices to be published and/or distributed in accordance with applicable law.
G. Authorization to Execute License Agreement with Westchester County for Shelter Supplies and Equipment
RESOLVED, that the Village Manager of the Village of Ossining is hereby authorized to execute a License Agreement with Westchester County for the use of pre-positioned shelter supplies and equipment to be provided by the County for use by residents during a natural disaster or emergency requiring people to leave their homes to seek temporary shelter, such Agreement having a five-year term and subject to the review and approval by Corporation Counsel.
H. Awning Permit Application - El Tambo, 57 Croton Avenue
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the application of Ayesha Goueas, filed on behalf of Croton Lane Associates L.L.C./c.o. Manny Rodrigues, for the installation of an awning at 57 Croton Avenue as submitted October 21, 2011.
I. Awning Permit Application - La Cuchara, 107 Spring Street
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the application of Franklin Crespo, for the installation of an awning at 107 Spring Street as submitted October 26, 2011.
J. Finance – Budget Modification for Bid Design Work for Sing Sing Channel
Improvements
WHEREAS, the Board of Trustees authorized a Memorandum of Understanding to be executed with the Metropolitan Transit Authority (MTA) to provide a coordinated plan design, bidding and construction involving Metro North’s Sing Sing Creek Improvement Project, and
WHEREAS, the MTA has provided the Village with a cost estimate of $23,097 for design of a bid alternate from HDR Inc. of Pearl River, NY, for a possible Village capital project, now therefore be it
RESOLVED, the Board of Trustees approves the following budget modification to transfer $24,000 from the General Fund Contingency Account to finance the cost of such engineering and design services and approves the 2011 General Fund budget to be modified, as follows:

K. Litigation Settlement Authority – USDC SDNY 08 Civ 7726
RESOLVED, that the Board of Trustees of the Village of Ossining hereby
authorizes and directs the Village Corporation Counsel to settle the matter pending in
United States District Court, Southern District of New York under Docket
No. 08civ7726 (WHP)(GAY), and authorizes payment in connection with same to the Plaintiff and Plaintiff’s attorney, as provided in Settlement Agreement dated September 13, 2011 as ordered by Honorable William J. Pauley, U.S.D.J.
L. Copier – Planning Department
RESOLVED, that the Village Manager is authorized to sign a lease for a copier with AdvancedCopier Technology, Inc. 16 Mount Ebo Road South, Brewster, NY 10509, for a 60 month period at the monthly amount of $235.71 totaling $14,142.60 for 60 months.
