Riverhead Man Caught Driving While Intoxicated With Kids, 8 And 5, On New Year's: Police

He's facing a felony charge, police say.

RIVERHEAD, NY — A Riverhead man was arrested after he was caught driving while intoxicated with two children, 8 and 5, in his vehicle, police said.

According to Riverhead Town police, the incident took place at 12:28 a.m. on January 1; police conducted a traffic stop in the area of Main Road and Linda Avenue in Aquebogue, officials said.

Upon investigation, Jose Torres, 53, the operator of a 2021 Toyota Tundra, was found to be intoxicated and had a 5-year-old girl and 8-year-old boy inside of his vehicle, police said.

Torres was subsequently arrested and charged with DWI, a felony under Leandra's Law, and two counts of endangering the welfare of a child, police said.

Torres was processed and held for morning arraignment, police said.
